Baramulla: In a bid to create awareness about Goods and Service Tax (GST)  and reach out to cross section of stakeholders, Jammu & Kashmir State Taxes Department  started first of its kind massive awareness campaign in north Kashmir’s Baramulla district.

A large number of Entrepreneurs, representatives from Traders, Commerce and Industry, Contractor associations and Tax practitioners participated in the program besides senior officers including Commissioner State Taxes Department, J&K, Dr Rashmi Singh, Additional Commissioner, Deputy Commissioners of SGST, Deputy Commissioner CGST, and State Tax Officers in attendance who focused on three themes like ‘Tax payers Awareness about different GST provisions, Small and Medium Sector Enterprises and issues related to Tax reimbursement and GST return filing.

Commissioner State Taxes Department, J&K, Dr Rashmi Singh appreciated the taxpayer’s cooperation in smoothly implementing the GST and congratulated them on the successful completion of 5 years of ‘ONE Tax, One Nation.”

Stating that the department is sensitive to all the issues of trade and industry, Dr Rashmi Singh emphasized that while the voluntary tax compliance is the life line of GST tax administration and the department functions in that spirit, the delinquent and fraud cases shall be dealt seriously and strictly as per the law.

She said that the feedback collected from the stakeholders during the course of the proceedings will be utilized to fine-tune the department’s response and also the future awareness programs.

Talking to media persons  President Traders Federation Sopore Mohammad Ashraf Ganaie said, “  “I congratulate the department for the GST reform and I actually got my GST registration within 3 days of my application at 12 mid night.”                                    

“Earlier we used make frequent rounds of Tax Department for collection of C- Form and different VAT Forms. Post GST implementation, we hardly visit the Tax office,” said General Secretary Traders Federation Baramulla  Tariq Ahmad Mugloo

Contractors Association, Bandipora Naseer Ahmad Mir said,  “This kind of awareness and interactive programs with the department/officers should be made a regular feature and Bandipora town should be chosen as venue for the next awareness program”.

The core issues and demands put raised by various stakeholders include that  the GST Law that allows buyer will get input tax credit only if it is paid by supplier is totally unreasonable and this responsibility should not be casted upon buyer and no coercive and hard action should be taken by authorities in such cases as it will amount to shut down of many small taxpayer’s business.

“ Downward revision on the interest rates for late payment of taxes. Quantum of penalty on E-Way Bill default should be reviewed and in view of E-Invoice being made applicable to all Tax payer having turnover more than 10 Crore, requirement of E-Way bill should be done away with in such cases as E-Invoice and E-Way bill contain 99% same information. Minor discrepancies in E-Way Bill causing huge Penalties should be overlooked and E-Way bill expiry cases should be dealt with compassion in view of frequent closure of Jammu-Srinagar National High,” the stake holders demanded.

They further demanded that single or at the most two tax rates should be adopted under GST besides immediate formation of GST Tribunal in UT of J&K.

The other demands raised during the campaign include that there are glitches in GST system which needs immediate attention from the government.

“Various amendments of GST law that concern the ordinary taxpayers that have been and are being made should be placed on a single dedicated website for the benefit and education of tax prayers. The threshold limit for GST Registration should be increased from current limit of 40 lacs to 1 Crore. The property ownership documents to be uploaded at the time of Registration are invariably in Urdu language and GST system asks for its English translation, the same may be done away with,” the stake holders urged the government to ponder over the issues.

They also appealed government and concern department to have amensity on the manufacturers who have failed to claim tax reimbursement in time may be given once chance to file their claim for previous quarters.

“Amnesty scheme should be brought in for VAT/GST arrears. Penality waiver for taxpayers who could not file the returns post August-5 and during Covid times besides State Taxes Department offices are being run from rented building and department should purchase land and construct their own office complexes,” they said.

The commissioner stated that several initiatives have been taken by the Government on the recommendations of GST Council from time to time for the simplification of GST and benefits of the taxpayers.

“ Yet there are certain more actions that may need to be addressed by the Government for improvement in the GST regime, and assured the representatives that all the issues raised will be placed before appropriate forums for considerations and redressal,” she informed.

She enjoined upon the taxpayers ensure discipline and to pay their due taxes and file their GST Returns in time. Commissioner emphasized that for redressing the genuine grievances of the taxpayers, officers in the department are commited to go the extra mile.
