Writes to chief secretary seeking clarification

Srinagar, July 19 :

Member of Legislative Assembly (MLA) Kupwara, Mir Muhammad Fayaz, has written to Jammu & Kashmir’s Chief Secretary seeking clarification on the constitutional role and competence of Chief Minister’s Advisor, Nasir Aslam Wani. Mir alleges that the advisor is trespassing into the jurisdiction of an elected legislator.

In his letter, a copy of which is in possession of news agency SNS KASHMIR , Mir describes the CM’s advisor as an “ultra-constitutional authority” and claims he is undermining the role of the elected MLA.

“I take this opportunity to seek clarification on the constitutional role of the advisor, and the discretion at his disposal to trespass on the domain of an elected MLA,” Mir wrote.

He further alleges that the advisor, who had contested against him in the recent elections and lost, is attempting to reverse the electoral verdict by using his current position to interfere in matters related to the Kupwara constituency.

“The person in question fought against me in the recently concluded elections and lost. He cannot reverse that outcome by using his position as an advisor to interfere with constituency matters and undermine the elected MLA,” he stated.

Mir described the advisor’s alleged conduct as a “majoritarian assault on democracy,” arguing that there is no constitutional scope for a ruling party to delegate macro-level legislative power to a defeated candidate to challenge an opposition MLA.

He claims that the advisor is a regular attendee in official meetings concerning his constituency. “He summons officers from my constituency, discusses plans with them, and ensures that my inputs are ignored,” Mir alleged, adding that he formally objects to the advisor’s presence in any official meetings until his constitutional authority and scope of responsibilities—if any—are clearly defined.
