Today Principal District and Sessions Judge Bandipora Mohmad Ibrahim wani Announced the Quantum of punishment in case FIR NO :105/14 u/s 148,341,506,302 Rpc P/ s Sumbal) who were convicted on 2-11-20 21.The accused no. 3 Gh. Ahmed parray has been awarded 10 years of simple imprisonment and a fine of Rs. 30000 to be paid to the wife of the deceased.
The accused no. 3 has been convicted u/ s 304 ii Rpc nd rest of the accused have been sentenced to three years of simple imprisonment u/ s 147 n one year imprisonment u/ s 341.
The court has further ordered that the period of imprisonment undergone by the accused persons during the investigation/trial of the case shall be set off against the sentence imposed.
The court of Principal District and Sessions Judge on 2 November 2021 convicted 9 accused persons accused of murdering a man namely Abdul Rasheed Wagey alias Rasheed Kaabli from Kathpora village of Hajin in November 2014.
As per the details police had registered a case FIR No. 105/2014 U/S 302,147,149,506, 427,341,34 RPC at police station Hajin after the occurrence of the offence and later the charge was framed U/S 302 RPC.
The case dares back to November 2014 when the deceased Abdul Rashid Wagay, a Sarpanch accompanied by his two PSOs had gone to the shop of accused Shakeel Ahmad Khan and demanded a gas cylinder from him.
Court observed that on refusal of giving gas cylinder by Shakeel Ahmad Khan, an altercation had taken place between the deceased and Shakeel Ahmad Khan. “Later-on, other family members of Shakeel Ahmad Khan joined in the fight and during the fight, the deceased was hit on his head by a blow of bat given by accused Ghulam Ahmad Parray who later-on succumbed to his injuries at SKIMS Soura,” Court further accused.
The prosecution examined 28 witnesses in this case and after conducting a full dress trial for a period of more than six years, the court has found accused No. 3-Ghulam Ahmad Parray guilty in killing the deceased Abdul Rashid Wagay while other accused persons have been found involved in the rioting and unlawful restraint.
“However, on the basis of evidence during trial section 304-ii RPC was established against one accused namely Ghulam Ahmad Parray, while rest of the accused persons have been convicted U/S 147, 341 RPC.
The other accused have been identified as Shakeel Ahmad Khan, Mushtaq Ahmad Khan, Mohammad Sultan Parrey, Bashir Ahmad Parrey, Showkat Ahmad Parrey, Firdous Ahmad Parrey, Feroz Ahmad Parrey and Hajira Begum—all residents of Kathpora Hajin.
Notably, the state and family of the victim was represented by chief prosecuting officer Bandipora, Abdul Majeed Bhat in the court.
