A major constitutional debate has emerged around the Special Intensive Revision (SIR) of electoral rolls in West Bengal, with legal experts stating that the Supreme Court’s reserved judgment in the matter could redefine the scope of voting rights and the powers of the Election Commission of India (ECI).
According to a legal analysis published by Bar and Bench, the case revolves around three crucial doctrinal issues, including whether the Election Commission can compel existing voters to re-establish their eligibility during a special revision exercise.
The matter pertains to the SIR exercise conducted in West Bengal ahead of the 2026 Assembly elections, during which over 91 lakh names were reportedly deleted from the voter rolls, accounting for nearly 12 percent of the electorate.
Legal scholars Vedant Chaudhary and Hardik Malik noted that the Supreme Court is expected to decide whether Section 21(3) of the Representation of the People Act, 1950 permits a fresh reconstruction of electoral rolls and whether the burden of proving voter eligibility can legally be shifted onto citizens already enrolled as voters.
The article also highlighted concerns over the use of a “logical discrepancy” category during the revision process, where software-based classifications allegedly flagged voters for inconsistencies such as spelling mismatches and age-gap anomalies. Critics argue that the algorithmic process lacked transparency and may have disproportionately impacted certain communities.
Another key issue before the apex court is whether Article 326 of the Constitution guarantees a justiciable constitutional right to voter registration or whether voting rights remain merely statutory in nature. The verdict is expected to clarify long-standing constitutional ambiguities concerning electoral rights in India.
The Supreme Court had earlier declined to stay the revision exercise but monitored the process through interim directions, including orders for broader acceptance of identity documents and publication of deletion data.(KNC)
