Accused Released on Bail After Court Holds Section 37 NDPS Act Not Applicable; Bail Granted on ₹1 Lakh Personal Bond

The Court of the Sessions Judge/Special Judge (NDPS Cases), Jammu, presided over by Parvaiz Iqbal, has granted bail to an accused, Maqsood Ahmad Lone, in a narcotics case registered by the Narcotics Control Bureau (NCB), Jammu, under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.
The bail application was argued by Advocate M.A. Dar on behalf of the accused, while the NCB was represented by Special Public Prosecutor Ajay Singh Manhas.
While allowing the bail plea, the Special NDPS Court observed that the stringent provisions of Section 37 of the NDPS Act, which impose strict conditions for granting bail in certain offences, were not applicable in the present case. The Court noted that the accused had already been discharged of the offence under Section 27A of the NDPS Act during the stage of charge/discharge.
The Court further observed that charges had been framed only under Sections 8, 15, 29 and 60 of the NDPS Act, offences for which the maximum prescribed punishment does not exceed ten years’ imprisonment.
Taking into account the facts, circumstances and legal position of the case, the Court granted bail to the accused subject to furnishing a personal bond of ₹1 lakh along with two sureties of the like amount to the satisfaction of the Superintendent of the concerned jail.
The Court also directed the accused to strictly comply with all the terms and conditions imposed while remaining on bail.(KNC)
