Srinagar, Nov 23:
The Chief Judicial Magistrate (CJM) Srinagar has ordered that the case involving eight police officials from Kupwara district be transferred to the Sessions Court Kupwara for trial.
The accused, including senior officers and constables, are facing charges under multiple sections of the IPC, including the serious Section 331, which deals with causing hurt to extort confession.
The accused are currently detained at Subsidiary Jail Humhama and have not yet been granted bail. On reviewing the case materials, the CJM noted that the offences fall exclusively under the purview of the Sessions Court Kupwara, particularly due to inclusion of Section 331 IPC.
As a result, the Srinagar court has now committed the case to the Principal District and Sessions Judge, Kupwara, for a full trial. The authorities, including the CBI, have been instructed to facilitate the transfer of all records and ensure the safe production of the accused before the Kupwara court on November 25.
The accused will remain in Humhama jail until further orders regarding bail are issued. Registry officials are ordered to consign all records for further proceedings in Kupwara. The CBI team has been directed to provide any needed security and assistance during the transfer and subsequent trial, underscoring the gravity of the allegations and the seriousness with which the judiciary is treating the matter.
