A local court in Central Kashmir’s Budgam district Tuesday convicted a man in a fraud case and awarded him a one-year jail term.
The court has also directed the accused to pay over Rs 7 lakh including 3 lakh as compensation to the complainant.
Notably, the convicted man identified as Muhammad Shafi Bhat of Nadirgund, Peerbagh, Srinagar had been arrested by police last year after several people claimed that he had duped them of their hard-earned money on the pretext of providing them jobs and other benefits. Bhat is currently languishing in the Kot Bhalwal Jail Jammu.
According to reports, the Court of Small Causes Judge convicted the accused for the commission of an offense under section 138 Negotiable Instruments Act only.
The court in its verdict said that Bhat will undergo simple imprisonment for a period of one year and is also sentenced by way of a fine to the tune of Rupees cheque amount plus half of the cheque amount as the case is of the year 2021 only, therefore, discretion is exercised in awarding lesser sentence instead of double the cheque amount.
The accused shall also pay an amount of Rs. 3 lakhs as compensation to the complainant.
The court said that the fine imposed shall be recovered by the issuance of a levy warrant to be executed by District Collector Srinagar authorizing him to realize the total amount of Rs. 73,50,000 by execution /attachment through civil process against both movable and immovable property of the accused.
