The United Nation’s Convention on the rights of Children (CRC) and the Constitution of India stand a guarantee in the case of the protection of rights of children especially in hostile conditions of conflict, war and natural calamities. It also acknowledges that the State and the Society have an obligation to protect the rights of every child in ordinary or extreme situation. While the Children in conflict with law are to be dealt with sensitivity to their age, respect for their dignity and human rights, the children in need of care and protection are to be protected from exposure to vulnerabilities . The children in conflict with law are to be given every opportunity to get rehabilitated and re‐ integrated with the society.
In Jammu and Kashmir, JJ Act that came into practice in 2018 commits itself to ensure that children in need of care and protection are adequately looked after (by their families or through alternate care systems) for their survival, protection and developmental needs. Children in conflict with law have been given opportunities to restore their dignity and self‐worth, and to develop themselves into productive and responsible members of the Society.
The Act aims at ensuring that the ‘best interest’ of the children is given primary consideration in all legal and administrative decisions and actions.
Under this act several homes run by the Social Welfare Deptt Have served as shelter for the children declared CNCP by the Child welfare committees constituted by the Juvenile Justice Committee headed by Hon’ble Justice of High Court.
Accordingly, Ministry of Women and Child welfare GoI has been whole heartedly providing funds to make these homes comfortable for the inmates. A complete system is in place to ensure the functioning of the homes as per the provisions of law in this regard. These homes are a beacon of light for the children affected by the conflict and are in need of care and protection.(CNS)
