JAMMU, Oct 12:
Central Bureau of Investigation (CBI) has registered a case against revenue officers/officials and others in the Roshni scam.
According to the FIR, a verification was conducted by Vigilance Organization into the allegations regarding bungling committed in the implementation of Jammu and Kashmir State Lands (vesting of ownership to the occupants) Act, 2001 commonly known as Roshni Scheme in Udhampur district.
The verification revealed that vide order dated July 3, 2007 ownership of different patches of land was conferred in favour of Chanchal Dass, son of Basti Ram, Jyoti Parkash, son of Mast Ram and Shadi Lai, son of Chandu of Sutain.
The perusal of the case files pertaining to vesting of ownership to these persons revealed that the beneficiaries are not permanent residents of Jammu & Kashmir and the files also do not contain their Permanent Resident Certificates. The vesting of ownership upon these persons was contrary to the provisions contained in Section 8 (1) (a) of the Jammu & Kashmir State Lands (vesting of ownership to the occupants) Act, 2001.
The verification also revealed that concerned revenue officers/officials are prima facie responsible for illegally conferring/vesting ownership rights upon these beneficiaries thereby by abuse of their official positions have conferred undue benefit upon them.
“The acts of commission and omission on the part of the then concerned officers/officials of Revenue Department, Udhampur and beneficiaries constitute offences under Prevention of Corruption Act read with Section 17 of J&K State Lands (Vesting of ownership to the occupants) Act 2001 and section 120-B RPC”, the Vigilance Organization said.
Therefore, in pursuance to the directions of the High Court of J&K passed in PIL No. 19/2011, the FIR No. 16/2014 of PS VOJ (now ACB) is re-registered against these persons and unknown officers/officials of Revenue Department Udhampur.
