Srinagar, Aug 24th :
The Special Mobile Magistrate (Traffic), Kashmir, has directed SSP Traffic Rural Kashmir to physically inspect the official vehicle of Tehsildar Sopore Tariq Ahmad Sheikh following allegations of unauthorised use of a red beacon/warning light and multi-toned siren.
The directions were passed by Special Mobile Magistrate Shabir Ahmad Malik on an application filed by Muzaffar Ahmad, who alleged that the vehicle was fitted with signalling equipment in violation of the Central Motor Vehicles Rules, 1989, and applicable provisions in J&K.
The Court, after examining the application, screenshots and other material, observed that a prima facie case warranted verification of the allegations.
Referring to the Supreme Court judgment in Abhay Singh v. State of Uttar Pradesh, AIR 2014 SC 427, the Court noted that unrestricted beacon use had been deprecated for fostering a VIP culture contrary to the rule of law.
SSP Traffic Rural Kashmir has been directed to ascertain whether the vehicle carries a red/blue beacon or multi-toned siren and whether their use has valid legal authorisation. Any unauthorised equipment found is to be removed or seized and appropriate action initiated.
The SSP has also been directed to submit a compliance report with photographs within two weeks.
Tehsildar Sopore has been asked to appear personally or through counsel on the next date and show cause why proceedings under the Motor Vehicles Act and Rules should not be initiated.
