Tribunal Seeks Government Stand on Officer’s Plea Against Disciplinary Action

A suspended Deputy Superintendent of Police (DySP) has moved the Central Administrative Tribunal (CAT), Jammu Bench, challenging the suspension order issued against him, prompting the Tribunal to seek a response from the Jammu and Kashmir Home Department.
Official sources said the police officer approached the Tribunal questioning the legality and circumstances surrounding the suspension, while seeking appropriate relief from the judicial forum. After taking cognizance of the petition, the CAT issued notice to the Home Department and other concerned authorities, directing them to file their response within the stipulated period.
The petitioner, through his counsel, is understood to have argued that the suspension order was not justified and sought intervention of the Tribunal for redressal of his grievances. The matter was taken up for preliminary hearing, during which the Tribunal examined the submissions and subsequently sought the government’s stand.
Sources said the case pertains to disciplinary proceedings initiated against the officer by the authorities. However, the merits of the allegations and the validity of the suspension will now be examined during the course of the proceedings before the Tribunal.
The Home Department and other respondents have been asked to place relevant records and their reply before the CAT. The case is expected to come up for further hearing after the filing of responses by the authorities concerned.
The development has brought the suspension matter under judicial scrutiny, with the Tribunal set to adjudicate on the issues raised by the petitioner in accordance with law.(KNC)
