Court Cites Security Concerns, Foreign Nationality and Difficulties in Ensuring Presence During Trial
Kralpora, October 29 :
The Court of Additional Special Mobile Magistrate, Kralpora, presided over by Mansoor Ahmad Mir, has rejected the bail application of two Myanmar nationals, Mohammad Hidayat and Nandar Cholwin, who were arrested in a case registered at Police Station Kralpora under Section 21 of the Immigration and Foreigners Act, 2025.
According to the prosecution, the two accused were apprehended on August 7, 2026, during naka checking while they were approaching the TCP from the Keran side. The prosecution alleged that they had entered Indian territory without valid travel documents or the requisite authorisation.
While dismissing the bail plea, the court observed that the alleged unauthorised entry into a strategically sensitive frontier area raised serious security concerns.
The court also highlighted the practical challenges involved in ensuring the accused persons’ presence throughout the trial, taking into consideration their foreign nationality and the absence of valid immigration documents.
It further observed that ordinary bail conditions would not be sufficient to guarantee their continued availability before the court during the proceedings.
The bail application was opposed by Additional Public Prosecutor Muzaffar Majeed, while the accused were represented through the Legal Aid Defence Counsel (LADC).
The court ultimately rejected the bail application, declining to grant relief to the two accused at this stage.(KNC)
